von rechts wegen ist es eigentlich so, daß wenn du zum h&m gehst und sagst, der pulli ist zu eng, bitte eine nummer größer... DIE sagen könnten: "pech gehabt, gibst ihn halt der caritas"
alles was der verkäufer dir gibt, auch wenns nur die möglichkeit umzutauschen ist, ist kulanz (von geld zurück ganz zu schweigen) also muß man schon froh sein, wenn man überhaupt einen gutschein kriegt...

natürlich kann man vor dem kauf so gut wie alles vereinbaren, auch zb. daß du geld-zurück-garantie hast, aber das muß dann auf deiner rechnung vermerkt werden, ansonsten schaust wieder durch die finger...

naja, wenn du einen Kaufvertrag wandelst weil eine Nachbesserung nicht möglich ist (z.B. weil das Ding seine beworbenen Leistungen nicht bringt), dann hast du sehrwohl einen Rechtsanspruch auf Geldzurück.

...aber ich denke, dass hast du nicht gemeint. "zurückgeben" war auch nicht klar formuliert
