vor allem der absatz: ...of any communication service without the express consent...
lässt sich für mich eben so auslegen, dass der communication provider das recht hat mir vorzuschreiben wie ich sein service nutze. grundsätzlich ok, aber: wenn in meinem vertrag nix drinnen steht von z.b. aufzeichnen mit videorecorder, heisst es, dass es explizit verboten ist und ich mich damit strafbar machen kann.

was in meinen augen das defacto ende von seiten wie dvdrhelp.com und ähnlichen angeboten darstellen würde. wenn man es strikt auslegt könnte auch noch ein rechtsstreit entflammen (und in den usa is es sicher so...) in dem es darum geht, inwieweit cd(dvd) brenner nicht grundsätzlich dazu gedacht sind um kopien von urheberrechtlich geschützten material anzufertigen...
zum thema prozesskosten usw. konnte ich leider nix finden (gebs zu, hab net allzu intensiv gesucht)
